HC dismisses criminal reference by sessions court

The Gujarat High Court has dismissed a criminal reference made by former additional principal sessions Judge PB Desai of Ahmedabad City Civil and Sessions Court to decide if the lawyer in a criminal case can continue to represent his client after death.

Dismissing the criminal reference, a division bench comprising justices Jayant Patel and S R Brahmbhatt observed that the Criminal Procedure Code (CrPC) is clear as daylight, and directed the Sessions Court to proceed with the trial in accordance with law.

The case relates to one Pankaj Modi who had filed a criminal complaint against the Ahmedabad Urban Development Authority (AUDA) and five others under the provisions of the Prevention of the Corruption Act and Indian Penal Code in connection with an alleged fraudulent land deal. Two of the five accused are Nalini Modi and Himanshu Modi, who are mother and brother of Pankaj.
